How to protect the interests of creditors on the Inheritance Law
------from the viewpoint of limited inheritance and disclaiming inheritance systems
Abstract: The limited inheritance and disclaiming inheritance systems can protect the heirs’ inherent property from being paid off forcefully as the intestate’s debts in their nature, and provide sufficient protection for the heir. The provisions in our concerning the two systems reflect this protection well, whereas ignore the protection of creditors’ legitimate interests, that is, it can not balance the interest between the heirs and creditors. This paper will put forward some improving suggestions by comparing with foreign legislation for our Inheritance Act.
